Car Rollover Accidents Lawyers

Colorado’s comparative negligence law is found under Revised Statute § 13-21-111. Colorado follows the rule of modified comparative negligence. What this means is that a victim’s damages can be reduced in proportion to percentage of fault and recovery will be barred if a victim is found more than 50 percent at fault for a collision or resulting injuries.  

Some of the ways insurance companies attempt to reduce liability by blaming victims of rollover collisions include:  

  • Failure to wear a seatbelt: More than three-quarters of those killed in rollover crashes were not restrained.  
  • Intoxicated driving: Those involved in rollover collisions, particularly single-vehicle crashes, are more likely to be intoxicated. Passengers who choose to ride with a driver under the influence may also be faulted.  
  • Unsafe driving: Speed, curb tripping, and other factors may be blamed.  
  • Roadway departure: A driver’s decision to leave the roadway to avoid a collision may be blamed.  
  • Unsafe vehicles: Bad tires or other mechanical issues may be blamed.  
  • Poor crash avoidance: About half of rollover accidents result from a driver attempting to take evasive action. Poor driving decisions and evasive maneuvering may be blamed.
