Property Management Negligence Lawyer

Most property injuries occur as a result of an unsafe condition. Whether because a dangerous condition was not corrected, or because a property owner, manager or tenant failed to warn guests, those injured on someone else’s property are typically entitled to be appropriately compensated.

Such personal injury and wrongful death lawsuits are pursued under the laws of premises liability in Colorado. At-fault parties may include tenants, property owners, property maintenance managers, property managers or other liable third parties, such as an at-fault driver.

Property Management Negligence Attorney in Denver

Consultation with an experienced property injury lawyer in Denver is best done as soon as possible after an accident because property owners or managers will likely quickly correct the dangerous or hazardous conditions that resulted in an injury accident.

Found under Section 13-21-115, the law  imposes duties on property owners, managers or tenants based on the visitor’s status as an invitee, licensee or trespasser.

  • Invitee: An invitee is on a property to conduct business, and is therefore owed the highest duty of care. Those injured  are entitled to collect damages if a danger or hazard exists that an owner, tenant or manager knew about or should have known about through reasonable diligence.
  • Licensee: A licensee is on a property for his or her own convenience or to advance his or her own interest. A visitor is considered a licensee under the law. when an owner failed to use reasonable care concerning dangers he or she knew about, or failed to warn of dangers he or she did not create and are not ordinarily present on the property, a visitor to a property may collect damages.
  • Trespassers: A trespasser is on a property without the consent of the landowner and is therefore owed the lowest duty of care under the law. A landowner is only responsible for injuries to a trespasser if deliberately or willfully caused by the landowner.

Special protections are in place to safeguard young children from property injuries under the attractive nuisance doctrine.
