  • Trespassers: A trespasser is on a property without the consent of the landowner and is therefore owed the lowest duty of care under the law. A landowner is only responsible for injuries to a trespasser if deliberately or willfully caused by the landowner.

This doctrine aims to protect children who may not understand the injury risks presented by dangerous conditions that may lure them onto a property, such as swimming pools, old appliances or abandoned buildings.
