Negligence Maintenance

Negligence Maintenance Attorney in Denver

Property owners have an obligation to keep their properties free from known or preventable hazards. When they fail to meet this duty of care under the law and someone is injured, victims may be entitled to compensation.

These types of claims are typically pursued under Colorado’s premises liability laws. Like most property injury cases, victims are best served by early consultation with a Denver personal injury lawyer because property owners and managers often act swiftly to correct hazards after an injury accident.

Found under Section 13-21-115, the law  imposes duties on property owners, managers or tenants based on the visitor’s status as an invitee, licensee or trespasser.

  • Invitee: An invitee is on a property to conduct business, and is therefore owed the highest duty of care. Those injured  are entitled to collect damages if a danger or hazard exists that an owner, tenant or manager knew about or should have known about through reasonable diligence.
  • Licensee: A licensee is on a property for his or her own convenience or to advance his or her own interest. A visitor is considered a licensee under the law. when an owner failed to use reasonable care concerning dangers he or she knew about, or failed to warn of dangers he or she did not create and are not ordinarily present on the property, a visitor to a property may collect damages.
  • Trespassers: A trespasser is on a property without the consent of the landowner and is therefore owed the lowest duty of care under the law. A landowner is only responsible for injuries to a trespasser if deliberately or willfully caused by the landowner.

The attractive nuisance doctrine may also hold landowners responsible for dangerous conditions on their property that result in injuries to young children, regardless of status, if those conditions could foreseeably entice a child onto a property. Examples include junk piles, abandoned and unsecured structures, and swimming pools that are not fenced or otherwise safeguarded.

Colorado Property Injury Lawsuits

Poor property conditions and inadequate maintenance are among the most common causes of property injury and premises liability claims. Common causes include:

  • Parking lots: Injuries caused by potholes, parking stops or uneven sidewalks. Poor lane markings, insufficient lighting,  lack of crosswalks, uneven sidewalks and inadequate signage all contribute to injuries.
  • Stairwell injuries: Bad lighting, loose stair treads and loose are missing handrails are common causes.
  • Slip and Trip hazards: Wet floors, loose or rolled rugs or carpeting, aisle obstructions, bad lighting, unmarked curbing and slippery ramps can result in injury.
  • Dangerous porches: Dangerous porches and balconies are an increasingly common problem. Rotted flooring and structural deficiencies that may fail under the weight of guests or snow and ice can result in serious or fatal injuries.
  • Inadequate security: In addition to businesses, rental residential properties can be targeted because of poor security, including bad lighting and missing, damaged or inadequate locks on doors and windows. Assault and other injuries commonly result.

Your chosen personal injury law firm in Denver must carefully investigate all of the facts and circumstances of your injury, identify all of the parties responsible as well as available insurance coverages, and determine the full extent of your damages, including economic and non-economic losses and punitive damages, if applicable.
